TERN OVERLAND TERMS OF SALE

1. Payment: Payment for in stock items must be received in full prior to shipment to Purchaser. Out of stock items for wholesal customers will be placed on a pre order list requiring payment in full at time of order.  Retail customer payments shall be paid by credit card. Wholesale customer payment shall be paid by check, credit card, bank draft, or wire transfer to Tern Overland LLC. Wire transfer details, if needed, will be sent by separate document.

 

2. Delivery: Seller shall deliver the Goods to the address provided by the Purchaser and indicated on the Invoice.

 

3. Acceptance and Inspection:  An adult signature is required for items valued at $100 or more. Shipping insurance is included in the sale price. To make a shipping damage claim, the Purchaser must document any damage to the package at the time of delivery with the delivery person, with photograph documentaion. The Purchaser must inspect the products and report any damage to Tern Overland LLC within 7 business days. Any shipping damage not reported within 7 business days shall be deemed “accepted as is” by the Purchaser and the product(s) will not be eligible for coverage. Tern Overland LLC, may at their discretion and expense, require the damaged product to be returned. 

 

4. Refunds and Cancellations: All returned goods must have a Return Merchandise Authorization (RMA) number. Returned Goods without an approved RMA will not be accepted.  All warranty returns are subject to our Warranty Policy.


5. Non-Warranty Returns: Requests for non-warranty refunds or exchanges will be considered for a period of 90 days from the date that the items were received by the purchaser. Requests for non-warranty refunds or exchanges beyond the 90-day limit will not be accepted.  All returned goods must have a Return Merchandise Authorization (RMA). Returned Goods without an RMA will not be accepted. If the Goods are returned for refund or exchange without cause, Purchaser shall pay the cost of original and return shipping with insurance, as instructed by the Seller. Returned items that are neither damaged during shipping nor defective per our warranty shall be considered “returned without cause”.  All returns for refund must arrive in the original container, with original packing materials, and in new condition. Refunds of stock items that are returned without cause shall be assessed a 10% restocking fee.  Special order items may not be returned unless defective or damaged during shipping.  Items that are refused at the time of delivery will be charged the full cost of original and return shipping plus a 10% restocking fee. It is the buyer’s responsibility to ensure that items returned without cause arrive at our facility complete, clean, undamaged, and in the original packaging. The cost of any cleaning, repairs, or replacement of lost parts or packing shall be deducted from the refund, along with the 10% restocking fee. Items that have been obviously installed or used are not eligible for refund.

 

6. Liability: Seller is responsible only for the delivery of Goods in good condition, and associated warranties. Seller is in no way responsible for consequential damages or liability arising from any use or misuse of these Goods. Tern Overland LLC accepts no liability for consequential damages, including local installation costs. Damage or problems caused by improper installation are not covered by this warranty.

 

7. Product Warranty: Tern Overland LLC warrants all Arctic Tern products to be free from defects in materials and workmanship for a period of one (1) year from the original date of purchase. If a defect arises within the warranty period, Tern Overland will, at its discretion, provide replacement parts or a complete product replacement. All shipping costs associated with fulfilling warranty claims will be covered by Tern Overland LLC. Please note that this warranty does not cover labor costs related to product removal, reinstallation, or repairs performed by third parties. Warranties are non-transferable and only apply to the original purchaser. Tern Overland may request the return of any product covered under warranty. In such cases, return shipping costs will be paid by Tern Overland. All returns must receive prior authorization and a valid Return Merchandise Authorization (RMA) number. Returns without prior approval or an RMA number will not be accepted.

 

8. Electronic Signatures: The completion of your purchase will be considered your agreement of these Terms of Sale.
